Brown Mogotsi is set to be back in court on 25 May 2026 after his first appearance at the Johannesburg Magistrate’s Court on Monday, 18 May 2026. The case was postponed to allow for the verification of his residential address before a formal bail application can proceed.
The North West businessman and self-proclaimed political fixer spent the weekend in police custody following his arrest on Friday, 15 May 2026 – just moments after he finished testifying before the Madlanga Commission of Inquiry in Pretoria.
What Charges Is Brown Mogotsi Facing?
Mogotsi is facing five charges, including:
- Defeating the ends of justice (primary charge)

Why Was the Case Postponed?
The State requested a postponement to verify Mogotsi’s residential address.
“The address that is to be verified is outside the province. Certain logistics are required for the police officers to move from one province to another.” – State prosecutor
Mogotsi’s legal representative, Makau William Sekgatja, attempted to push for a shorter postponement (Thursday instead of Monday), arguing that the address in Mmabatho, North West, had already been submitted.
However, the magistrate ruled in favour of the State, postponing the matter to 25 May 2026. Mogotsi will remain in custody until then.
The Alleged Staged Assassination Attempt

Background: The Madlanga Commission Testimony
Mogotsi was arrested shortly after testifying before the Madlanga Commission of Inquiry at the Brigitte Mabandla Justice College in Pretoria on 15 May 2026.
At the commission, Mogotsi had attempted to have evidence leader Matthew Chaskalson recused, but his application was dismissed by chairperson Justice Mbuyisile Madlanga.
During his testimony, Mogotsi initially refused to answer certain questions, stating: “I’m not going to incriminate myself”. After consulting his legal team, he agreed to continue.
Evidence presented at the commission also contradicted Mogotsi’s claim that he had operated as a Crime Intelligence contact agent since 1999.
